• You acknowledge that the Purchase Services offered by Casibri integrate delivery (the ‘ Delivery Services’) through the use of third party delivery companies (the ‘ Delivery Service Providers’).
  • In providing the Purchase Services, Casibri may provide you with a variety of delivery and insurance options offered as part of the Delivery Services by the Delivery Service Providers. You acknowledge and agree that Casibri is not the provider of these delivery and insurance options and merely facilitates your interaction with the Delivery Service Providers in respect to providing the Delivery Services.

    Dispute Resolution

  • Compulsory: If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought). 
  • Notice: A party to the Terms claiming a dispute (‘Dispute’) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute. Resolution: On receipt of that notice (‘Notice’) by that other party, the parties to the Terms (‘Parties’) must:
    • Within 14 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree; 
    • If for any reason whatsoever, 14 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the sole trader Venera Ghazaryan or his or her nominee; 
    • The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a pre-condition to the mediation commencing. The Parties must each pay their own costs associated with the mediation; 
    • The mediation will be held in Sydney, Australia.
    • Confidential: All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.
    • Termination of Mediation: If sole trader Venera Ghazaryan have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

      Shipping and handling  general / shipping and returns 

      Casibri will do its best to dispatch your order from its warehouse in Sydney, Australia as soon as possible, which usually takes 1-2 business days You acknowledge that these times may be subject to change depending on peak periods. 

      If your product is faulty or damaged during shipping, please notify Casibri within 7 days from receiving of the good. If your product(s) is eligible for a free of charge repair or replacement, you will have to post it back with a valid tracking number within a week after getting confirmation from the support team. Your product must be unused, in the same condition that you received and with original packaging. Items that are damaged as a result of normal wear and tear are not considered to be faulty. 

      Casibri will provide you a valid tracking number for your postage, as soon as it dispatches from the warehouse. Parcels using a tracked shipping method means that you can trace the package through to delivery with information like: the expected delivery date, delivery delays, where it is and who has it, delivery options. 

      Casibri does not take any responsibility for shipping delays or items sent to invalid or incorrect addresses. Items deemed in transit, delayed items, are not permitted for a refund. We will not reship or refund the package, if the tracking status shows your package as “delivered”. Some ‘ Delivery Service Providers’ will deliver your package to your door, porch, mailbox etc. Casibri does not hold any responsibility for any theft or damage if your package is left unattended. If your package is lost by the ‘ Delivery Service Providers’, Casibri will give you a complimentary replacement.

      International shipping costs do not include any possible import taxes or customs fees related with collection. The receiver is responsible for payment of any duties or taxes including any fees incurred. Failure to pay customs/duties may result in your package being deemed undeliverable or returned. Casibri is not responsible for the returned items to sender if the address is incorrect/insufficient; the package is unclaimed from the post office; due to failure to pay taxes/customs fees. It is the Customer’s responsibility to contact Casibri on [email protected] email to re-arrange the shipping.  You may be liable to pay for the postage costs.

      Returns and exchanges 

      Under no circumstances will monogrammed or customised products be accepted for return due to change of mind. We do not refund or exchange monogrammed or customised products unless the item is faulty.

      Casibri is not liable for incorrectly purchased products. If an item is incorrect, Casibri is unable to exchange, replace or refund these products.
